Information regarding the processing of personal data

KME Group S.p.A., a company incorporated under Italian Law, together with its subsidiaries and/or associates (hereafter “KME”), is particularly careful about aspects regarding the privacy of all those who, for whatever reason, come into contact with the Group. By means of this page, it intends to describe the ways in which it manages its own website in relation to the processing of the personal data of users who access and consult it.

This information is supplied pursuant to Italian Law, and in particular of Art. 13 and 23 of Italian Legislative Decree no. 196 of 30 June 2003, “Personal data protection code” (hereafter “Leg. Decree 196/03”) to those who interact with the services which may be accessed online from the address: http://www.kme.com. The information is supplied only for the above-mentioned website (hereafter the “Site”) and not for other websites which users may be able to consult via links which may be found on the Site.

Type of data processed

Web surfing data
During their normal operations, the IT systems and the software procedures set up for the operation of the Site acquire some personal data, the transmission of which is implicit in the use of the Internet communication protocols. This is information which is not collected in order to be associated with the data subjects identified, but which by its very nature could enable identification of users, through its processing and association with data held by third parties.

This category of data includes IP addresses or computer domain names used by users who connect to the site, Uniform Resource Identifier addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the status of the reply given by the server (successful, error, etc.) and other parameters relating to the operating system and the IT environment of the user. This data represents the register of connections.

This data is used for the sole purpose of acquiring anonymous statistical information on the use of the Site and to check its correct functioning and is kept for the time established by the relevant legal provisions. The data could be used to ascertain responsibility in the case of any IT crimes which damage the site.

Registration data
In order to be able to use some online services offered by the Site, specific information will be supplied on each occasion and, where necessary, users will be asked for specific consent to the processing of their personal data and it will be necessary to register.

Users are free to supply the information requested during registration, but the failure to supply such data may make it impossible to access and use the online services requested.
The optional, explicit and voluntary sending of email to the addresses of KME recipients indicated on the Site implies agreement to the processing of the personal data supplied and entails the subsequent acquisition of such data, which may include, by way of example, the sender's email address, which will be used by KME to reply to the user’s requests.

Cookies
No users’ personal data is deliberately acquired by the Site. No use is made of cookies for the transmission of personal information. The use of so-called session cookies (which are not permanently memorised on the user’s computer and disappear with the closure of the browser) is strictly limited to the transmission of session identification codes (consisting of random numbers generated by the server) needed to enable the secure and efficient exploration of the site. The so-called session cookies used on the Site avoid the use of other IT techniques which are potentially prejudicial for the confidentiality of users’ navigation and do not enable the acquisition of users’ personal identifying data.

Purpose of data processing
The data supplied by users through the consultation of the Site can be processed directly and/or through third parties, solely for the following purposes:

  • requirements closely connected to and functional to the use of the Site and related services;
  • definition of profiles and/or recording customer satisfaction;
  • observance of contractual provisions and obligations arising from ongoing legal relations with KME
  • carrying out market research, economic and statistical analyses.

Methods of data processing
The means of processing connected to consultation of the Site consist of the collection, registration, organisation, processing, extraction, interconnection, deletion and destruction of data, including the combination of two or more of these operations.

The personal data may be communicated exclusively for the above-mentioned purposes and in compliance with the provisions in force, in Italy and/or abroad to companies forming part of the industrial group and/or third parties appointed by KME which provide a range of services on its behalf.

The data is processed by means of electronic or automated tools, which adequately ensure confidentiality, in compliance with the KME Security Planning Document, prepared pursuant to Art. 34 of Leg. Decree 196/03.

Specific security measures are observed in order to prevent the loss of data, illicit or incorrect use and unauthorised access, but KME cannot accept responsibility for any unauthorised access or loss of users’ personal information which is beyond its control.

We hereby inform you that some communications via Internet, such as for example emails, could be delivered to KME recipients resident in countries other than that where the message has been originated; in such cases any personal data supplied will be preserved and used in compliance with local laws of the country where the KME recipient of the transmitted message resides.

Rights of data subjects
Data subjects to whom the personal data refers have the right at any moment to obtain confirmation of the existence or otherwise of the same data and to learn its content and origin, check its accuracy or ask for its integration or updating or rectification pursuant to Art. 7 of Leg. Decree no. 196/2003.

Pursuant to this article, users have the right to ask for the deletion, anonymisation or the blocking of data processed in violation of the law, as well as opposing its processing in any case for legitimate reasons.

Data controller
The controller of the personal data is KME Group S.p.A. with its registered office at Via dei Barucci no. 2, 50127 Florence (Italy). KME has arranged to appoint managers for the individual processing of data, and therefore any information may be requested from the Privacy Office established at the offices of Via dei Barucci no. 2, 50127 Florence (Italy), which may be contacted at the following email address: ufficioprivacy@kme.com .

KME reserves the right to modify or amend, at any time, this privacy policy, especially by the virtue of the coming into force of new provisions for the sector.
